Advocates of the change say the funds absorbed by Planned Parenthood can be directed to other community health centers instead. The clinic had filed an injunction in December asking that it be allowed to resume abortions in Columbia. Clinics, including Planned Parenthood, that received funding in September will run out at the end of next month and the new cycle is set to start April 1.

Federal funding does not pay for abortion services.

The rule, which covers clinics at 85 sites in Washington state, has two unlawful provisions, Ferguson said.

Judge Brian Wimes said that the admitting privileges requirement did not affect enough women to constitute an undue burden.

"The new regulations would make drastic and harmful changes to the Title X program", said Joseph Alifante, president and CEO of the New Jersey Family Planning League, a nonprofit organization that receives and distributes the state's share of Title X funding to organizations throughout New Jersey.

As a legal point, Ferguson said the rule-which would boot Planned Parenthood and any other clinic that offers abortions from the network and prohibits direct referrals for abortion-violates the Affordable Care Act's mandate against limiting what information clinicians can give to their patients. According to the staff there, about 96 percent of the services the Bend clinic provides is preventative-including screenings and treatment for sexually transmitted infections, birth control, cancer screenings and annual well exams, as well as vasectomies and prenatal care.

Ferguson's suit says the rule will force many providers out of the program and prevent thousands of mostly poor women in Washington from receiving other vital health care services.

Ferguson told reporters on Monday the rule would bar the state's clinics that offer nearly 90% of Washington's Title X services.

The new rule requires "clear financial and physical separation between Title X funded projects and programs or facilities where abortion is a method of family planning". Organizations that receive those funds would still be able to perform abortions, but would have to do them in physically separate facilities. Under the new restrictions, any clinic accepting federal funds would be prevented from performing abortions - or referring women to other providers for the procedure.

The new regulation was published Friday on an HHS website.

However, several things have changed since that case was decided, Ferguson said, including new statutes passed by Congress that impose new requirements on the Title X program.

Up until January 22 of this year, in New York State, late term abortions (anything after 20 weeks of gestation) were illegal, and a considerably unorthodox practice to many people. The Center for Reproductive Rights has said it will sue on behalf of family planning providers in Maine.
